In particular, we believe it is important for you to know how we treat information about you that we may receive from this web site or through any reward program, special offer, communication, advertising, and other related services. Information Collected
WalkStyles™ collects personal information about you when you register for our products and services, or purchase items from our online store. In order to register for our subscription services or purchase from our online store, we ask for information such as your name, address, zip code, and email address. We may also ask for credit card and if applicable, other pertinent billing and shipping information. At times, we may request information via surveys, polls, events or contests. Participation in these areas of the site is completely voluntary.

This web site and its services are not intended for persons under 16 years of age. We do not knowingly solicit or collect personal information from or about children, and we do not knowingly market our products or services to children. If you are under 16, you may use WalkStyles.com only with the involvement of a parent or guardian.

Additional Information Collected Specific to Subscription Services
To sign-up as a member for our subscription services, whether they be free or fee-based services, we also ask for information such as your age and gender, a WalkStyles screen name, a fitness profile, and basic demographic information. Not all of this information is required. Required information is clearly marked during the registration process. Once you register with WalkStyles and sign in to our services, you are not anonymous to us. As a WalkStyles subscriber, we collect and store information provided by you and at your option, to help you manage your overall wellness at the web site as well as to maximize the accuracy and enjoyment of your DashTrak or other fitness device – examples are your goals and actual tracking data for daily steps or step-equivalents, diet and nutrition, and other personal wellness activities, as well as your weight, height, stride length, and personal notes or thoughts. Use of the ICount™ Diagnostic Tool collects answers to personal health and lifestyle questions.

WalkStyles also enables subscribers to establish public and/or private clubs and/or establish one-to-one member relationships, or SoleMates™ (all collectively referred to as “WalkStyles Groups”), and WalkStyles therefore stores both descriptive information about the group as well as a listing of its members.

Use of Collected Information
We do not share, sell, or lease personal information about you, WalkStyles Groups that you administer, or any WalkStyles Groups that you participate in, to any third-parties for their marketing use. We will release information about you or if applicable, a WalkStyles Group you administer, if you direct us to do so, if we are required by law to do so, or in other legally limited circumstances (for example, suspected illegal activities, suspected fraud, or violations of the WalkStyles Terms of Use).

We may share the personal information you provide with trusted partners we have hired to provide services for us. These companies - our vendors - are contractually bound to use personal information we share with them only to perform the services we have hired them to provide and are bound by the same confidentiality.

The WalkStyles Services constitute a community site where the intention is for its members to share and view each other’s profile information, including name and/or screenname, activities, times, geographic location (by zip code), common interests, birthdate, occupation, and in some instances, step and other exercise data. It is possible for members to contact one another indirectly using the WalkStyles Services. WalkStyles may report on its members reaching certain step count milestones or goals on its site and as part of the WalkStyles Services. At all times, your identity is shown via a screen name chosen by you, and in some circumstances and if desired by you, your full name or abbreviated form of your full name. Your email address, street address, phone number and billing information are never made available to another member by the WalkStyles Services. As a member, you have the ability to control the amount of profile information publicly available on the site by specifying certain account options. In addition, designating the account option as “limited” will block the profile from direct member searches or from showing up in WalkStyles reports recognizing achievement. However, please see the section below on Special Considerations for Sponsored Accounts for possible exceptions.

When you join a WalkStyles Group, you are electing to share your step data to that group for use in statistical reporting and for comparison purposes in club charts, goals and contests. In addition, the administrators of the Group may in some instances be able to generate a report which contains the individual daily step counts for all members over a given time period. Participating in a WalkStyles Group is done at your discretion and you can elect to cancel your participation in any group at any time. You may also create your own WalkStyles club. If you elect to create and therefore to administer your own club, you will be available to be contacted from those you have invited to be members of your club, and to those inquiring about the club.

Answers to the ICount Diagnostic Tool are used to provide you with an overall wellness rating (for entertainment purposes only).

At times, we will share aggregated demographic information with our business partners and advertisers. Also, the step count data, results of the ICount Diagnostic Tool, and demographic information is used to report, in aggregate, the trends, breakdowns and other statistical information with regard to step data and general health of our members. We may also use, in aggregate, the step count data for our own marketing purposes. In each of these cases, the aggregated information is anonymous and is not linked to any personally identifiable information for a given individual. All other individual fitness and wellness information not mentioned above is only used to provide the services available to you as a subscriber to chart and record your activities. This other information is not shared in any way, either individually or in aggregate.

Like most e-commerce sites, when you visit our site, we collect your IP address and collect information regarding your use of the WalkStyles web site. Your IP address and your site usage are not used to personally identify you. This information is instead used to administer the site and aggregated anonymously to help analyze trends, measure the number of visits, average time spent on the site, pages viewed, etc. This information allows us to improve the content and usability of our site.

Special Considerations for Sponsored Accounts
Some paid subscription accounts may be sponsored (paid for) by a third party, such as a corporation for its employees, or an organization for its members. Signing onto the web site as a sponsored account is at your discretion and is clearly outlined in the sign-up process, where you will be required to use a special access ID and license number. Creating and signing up as a sponsored account joins you into a WalkStyles Group consisting of all of the organization’s sponsored accounts, or members. You may also be subject to receiving e-mail or other communications through the WalkStyles site from the Group administrator without consent.

Data associated with sponsored accounts is subject to additional usage. The additional use of data may include the following:

1. A sponsoring organization can create a set of wellness pages that may include contest results, member spotlights, etc. This information may include your full name, step data, and ‘why I Count’ description, but in all cases, these pages are only viewable by members who are part of the same sponsored organization, and not by the general membership.
2. The ICount Diagnostic Tool data can be combined with other sponsored-accounts and reported in aggregate to the organization. This data is NOT provided for individual users and aggregate information does not contain any personally identifiable information.
3. The date, if any, that you completed the ICount Diagnostic Tool can be supplied to the sponsoring organization if requested. Neither your answers, your score, nor any other information is supplied.

Account Information & Marketing Preferences
For registered subscribers, you can edit your WalkStyles account information, including marketing preferences at any time. After logging in, your account information can be accessed from within the ‘My Account’ link on the WalkStyles.com website.

Marketing preferences allow you to specify whether or not to be included in communications from WalkStyles as well as communications from WalkStyles enabled communities/clubs that you join. Opting in to receiving such communications allows WalkStyles to send you special offers and other messages that may be of interest to you both from us and our trusted partners. You may also have the ability to unsubscribe to certain communications by following the instructions contained in the messages you receive.

We reserve the right to send you certain communications relating to the WalkStyles service, such as service announcements, administrative messages and the WalkStyles Direct Newsletter, that are considered part of your WalkStyles account, without offering you the opportunity to opt-out of receiving them.

Security of Collected Information
Your information is maintained on a web server in what we believe to be a well protected environment. We maintain strict physical, electronic, and administrative safeguards to protect your personal information from unauthorized or inappropriate access. However, WalkStyles cannot guarantee that your information will remain secure from unauthorized access.

We restrict access to information about you to those WalkStyles employees who need to know the information to provide products or services to you or to respond to your inquiry or request. Employees who misuse personal information are subject to disciplinary action, including termination.

Your WalkStyles account is password-protected and in some cases, most notably during billing and credit card submissions, WalkStyles uses industry-standard SSL-encryption to protect data transmissions.

Cookies & Sessions
Like most web sites, some areas of this web site utilize 'cookies' that are enabled on your machine to enhance the online services supplied by the web site. The site also uses 'Sessions' for securing areas and providing personalized services. These mechanisms are employed solely for convenience in order to provide personalized time and cost saving services. They do not contain any identification that would be useful to another individual or organization.

Public vs. Confidential Information
Other than personal registration information and personal wellness data, you acknowledge that all of your submissions and postings to public portions of the web site (including, but not limited to, message boards, chat rooms, public clubs and communities) are public and not private information. WalkStyles specifically disclaims any liability with regard to any actions resulting from your submissions and postings to public portions of the web site. Generally, any communication or information which you post to the web site is considered to be non-confidential.

The WalkStyles web site may contain links to other sites. Whether or not these other website contain our brand names, intellectual property, or trademarks, we do not control these other web sites nor their business practices, and this privacy policy does not apply to these other web sites. Consequently, these other web sites may collect different kinds of information and use this information in different ways than we would if collect on this site.
